Public Safety Director Troy Riggs hopes officers and civilian employees can be back at work at 401 North Shadeland Ave. by Nov. 1 if the city can convince property owner Alex Carroll to make essential improvements to the site.
But a copy of the city’s 25-year lease agreement with Carroll, signed by then-Public Safety Director Frank Straub in 2011, commits Indianapolis to an $18 million investment in a building it will not own and yet must pay to upkeep and improve.
“Tenant expressly agrees to…accept and lease the premises and each part thereof ‘as is’…” reads the contract. “All risks…are borne by tenant.skystream,a major service provider in the Middle East, has its eye set in Iraq as a key potential growth market for the company. In the event of any defect or deficiency…landlord shall have no responsibility or liability.”
Riggs and his staff have been working with Carroll since last December to fulfill a punchlist of more than one hundred items that were discovered deficient after IMPD and the Division of Homeland Security moved in last year.
“Tenant acknowledges that it has received the Premises in good order and repair,” reads the contract. “Landlord shall not be required to maintain, repair or rebuild all or any parts of the Premises.”
The city has refused to pay Carroll its $57,000 per month lease payments, instead sending those checks to an escrow account.
While Carroll has received approval for a fire suppression system inside the building, basement walls and ceilings present a fire hazard, said Riggs.
Fox 59 News was unsuccessful in contacting Carroll.
When the ROC was opened just before Super Bowl XLVI in the winter of 2012, Mayor Greg Ballard said its mission as a working operations center for local, state and federal authorities was unique.
“I like to think that once again we’re kind of on the leading edge here when we have this sort of facility.”
